Agreement Overview
This Agreement defines the terms of participation in the 888Starz Affiliate Program as an “Affiliate.” By agreeing to these rules, you acknowledge and accept the guidelines outlined herein. The Affiliate Program reserves the right to amend these conditions at its discretion, and all changes will be considered binding upon notification.
Key Terminology
- Client: Refers to a customer utilizing the Affiliate Program’s services through affiliate promotions.
- Offer: The specific terms and opportunities provided by the Affiliate Program, detailing commission structures, promotional methods, and other cooperation guidelines.
- Affiliate Program Website: The official portal for affiliates, accessible at 888starzpartner.com.
- Sub-Affiliate: A third party recruited by an Affiliate to promote Offers, subject to approval and compliance with the Affiliate Program’s policies.
Guidelines for Participation
Affiliates may engage in the 888Starz Affiliate Program under the following conditions:
- Account Access and Security: Affiliates will receive unique login credentials for the Affiliate Program Website, which must remain confidential. Sharing credentials or allowing third-party access is prohibited.
- Eligibility Requirements:
- Affiliates must be of legal age in their jurisdiction, with a minimum age requirement of 18 years.
- Sub-Affiliates may be hired only with explicit written consent from the Affiliate Program. Affiliates bear full responsibility for their Sub-Affiliates’ actions and adherence to the Agreement.
- Accuracy of Registration Information:
- The Affiliate Program retains the right to verify all registration details. If inaccuracies are found, access may be restricted, and payments may be withheld.
Affiliate Obligations and Rights
- Approved Advertising Materials: Affiliates must use only the marketing assets (banners, logos, and other creatives) provided or approved by the program. Any custom materials require prior written authorization.
- Website Management: Affiliates are responsible for the maintenance and compliance of their websites, ensuring technical functionality, content accuracy, and adherence to laws and intellectual property rights.
- Trademark Use: Affiliates are granted a limited, non-exclusive license to use the Affiliate Program’s trademarks solely for promotional purposes. This license is non-transferable and cannot be sublicensed.
Offers and Commissions
- Offer Details: Affiliates may access and promote available Offers as outlined by the program. These Offers include specifics on commission calculation, payment formats, and terms of cooperation.
- Commission Payments:
- Commissions are determined by traffic quality and volume, with payouts on a weekly or monthly basis (NET-7 or NET-30).
- The minimum payout threshold is $100. Affiliates must generate at least three active players within a billing period to qualify for payments.
- Delayed payments may occur if Affiliates fail to provide accurate details or required documentation.
- Revenue Share commissions are capped at 25% for traffic from certain countries, including Somalia, Bangladesh, Egypt, and Uzbekistan.
Prohibited Activities
The following activities are strictly forbidden:
- Using fraudulent methods to generate leads or traffic, including unauthorized automated systems.
- Promoting the Affiliate Program through spam emails, unapproved contextual ads, or intrusive ClickUnder/PopUnder ads.
- Publishing misleading, defamatory, or unlawful content related to the Affiliate Program or its Offers.
Non-compliance with these rules may result in account suspension, forfeiture of commissions, and permanent removal from the program.
Termination of Cooperation
- The Affiliate Program may terminate this Agreement at any time with six (6) hours’ notice. Affiliates may terminate their participation with forty-eight (48) hours’ written notice.
- Upon termination, Affiliates must promptly remove all promotional content, deactivate links to the Affiliate Program, and return any Confidential Information.
Confidentiality
Affiliates must treat all shared business information as confidential. This includes but is not limited to strategies, marketing plans, and client data. Affiliates agree to:
- Use Confidential Information solely for program-related purposes.
- Avoid disclosing such information to unauthorized parties without written consent.
These obligations remain in effect even after the Agreement is terminated.
Legal Obligations and Indemnity
- Compliance with Laws: Affiliates are responsible for adhering to all relevant legal and regulatory requirements in their jurisdiction and those outlined by the Affiliate Program.
- Indemnity: Affiliates agree to indemnify the program against any claims, losses, or damages resulting from violations of this Agreement or their participation in the program.
General Provisions
- Modification of Terms: The program reserves the right to revise or update this Agreement at its discretion. Affiliates are encouraged to review the Terms regularly to remain informed.
- Governing Language: In cases of discrepancy between the English and Russian versions of this Agreement, the English version will prevail.
